Speaking after today's Transport Select Committee seminar on whiplash, Dominic Clayden, claims director, Aviva, said: "There is a whiplash epidemic in the UK with more than 570,000 people a year making a claim, adding around £90 to the average motor premium.
"We believe any solution to whiplash needs to include three core elements: the MoJ (Ministry of Justice) needs to increase the small claims limit to £5,000 and/or reduce the level of damages awards; the focus in a whiplash claim should be on helping the injured person through rehabilitation; and there needs to be a change in legislation which results in a ‘non-fault’ party being required to notify the ‘at fault’ insurer at the same time as their own insurer – giving the defendant the first chance to pay the claim and admit liability – or ‘right the wrong’."
