Netherlands: Delta Lloyd extends writ of attachment on Heijloo & Molkenboer

Delta Lloyd is extending the writ of attachment on Heijloo & Molkenboer to third parties, securities portfolios, registered shares and homes.

Delta Lloyd is extending the writ of attachment on Heijloo & Molkenboer to third parties, securities portfolios, registered shares and homes. The court granted Delta Lloyd permission to do so yesterday. Delta Lloyd is taking this action because the previous writ of attachment only covered a faction of the amount claimed by Delta Lloyd. At a hearing on 5 January, Delta Lloyd’s fears that the success of its claim might be in danger were confirmed when the partners stated at the hearing that they were not prepared to disclose the whereabouts of the NLG 25 million previously paid by Delta Lloyd.

On 5 January, interim injunction proceedings were held on previous writs of attachment. The court upheld the writs of attachment filed by Delta Lloyd, apart from the writ against the financier of the proceedings, Sirus. The purpose of Delta Lloyd’s writ is to secure its alleged claim of about €17 million against the partners.

Delta Lloyd is involved in a court case with the former partners of Heijloo & Molkenboer. Delta Lloyd believes that the bankruptcy of the intermediary is the result of mismanagement and is therefore claiming the funds previously invested by it plus costs.
